These Terms of Use (“Terms”) govern your access to and use of the website located at https://cartalyst.ai (the “Site”) and the services provided under the Cartalyst AI brand (“Cartalyst”, “we”, “our”, “us”).

Cartalyst AI is operated by Afanasiev Robert Olehovych, a registered individual entrepreneur in Ukraine.

By accessing the Site or using our services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Site or our services.

  1. Eligibility

You may use the Site and our services only if:

You are at least 16 years old.
You have the legal capacity to enter into binding agreements.
If using the Site on behalf of an organisation, you are authorised to bind that organisation to these Terms.

Your use of the Site on behalf of an organisation constitutes that organisation's agreement to these Terms.

  1. About the Service

Cartalyst AI provides AI-powered software and conversational AI solutions that may integrate with third-party platforms, websites, e-commerce stores, and other business systems.

The Site provides general information about Cartalyst AI, including product descriptions, service overviews, marketing materials, contact forms, and enquiry submission tools.

Any commercial engagement with Cartalyst AI’s products or services may be governed by a separate written agreement. Where such an agreement conflicts with these Terms, the separate written agreement will prevail.

  1. Permitted Use

You may access and use the Site solely for lawful purposes, including:

Learning about Cartalyst AI and its services.
Evaluating our services for potential commercial engagement.

  1. Subscription, Billing, and Suspension
    4.1 Free Trial

Where offered, access to Cartalyst AI services may be provided free of charge for an initial trial period. The duration and scope of any trial will be communicated separately.

4.2 Billing

After any applicable free trial, continued use of the service may be subject to fees as set out in the relevant commercial agreement, proposal, invoice, or order agreed with the client.

4.3 Suspension for Non-Payment

If payment is not received by its due date, Cartalyst AI may provide written notice to the client and may suspend access to the relevant services if payment remains outstanding.

Cartalyst AI will use reasonable efforts to provide notice before suspension but is not liable for losses resulting from suspension caused by non-payment.

4.4 Termination and Data Deletion

Upon termination of a client relationship, client data stored on Cartalyst AI infrastructure will be handled in accordance with the applicable commercial agreement and our Privacy Policy.

Requests regarding deletion of data may be submitted to robert@cartalyst.ai.

  1. AI-Generated Outputs and Limitations
    5.1 Nature of AI Services

Cartalyst AI services may use artificial intelligence systems that can produce inaccurate, incomplete, or inappropriate responses.

Any recommendations, classifications, generated content, product information, or other AI-generated outputs should be independently reviewed where appropriate.

5.2 Limitation of Liability for AI Output

To the extent permitted by law, Cartalyst AI is not liable for loss or damage resulting solely from reliance on inaccurate or incomplete AI-generated outputs.

Clients are responsible for determining whether additional human review or controls are required for their specific use case.

5.3 Our Commitment

Cartalyst AI works to improve the quality and reliability of its services and will take reasonable steps to address reported issues.

However, no AI system can guarantee error-free performance.

  1. Privacy

Your use of the Site is also governed by our Privacy Policy available at https://cartalyst.ai/privacy.

The Privacy Policy is incorporated into these Terms by reference.

  1. Intellectual Property

Unless otherwise stated, all content on the Site, including text, graphics, logos, designs, software, and code, is owned by Cartalyst AI, its operator, or its licensors and is protected by applicable intellectual property laws.

Except for the limited right to access and use the Site, no intellectual property rights are transferred to you.
